Vergütung: BFH zur Begünstigung von Abfindungen

November 2009Zahlen Sie einem Mitarbeiter Ihres Unternehmens eine Abfindung, weil dieser seine Wochenarbeitszeit auf Grund eines Änderungsvertrags unbefristet reduziert, kann es sich dabei um eine steuerbegünstigte Entschädigung handeln (§ 24 Nr. 1 a EStG). Das hat der Bundesfinanzhof in einem Fall festgestellt, in dem eine Beschäftigte ihre wöchentliche Arbeitszeit um die Hälfte reduzierte und dafür eine Abfindung in Höhe von 17.000 € erhielt (BFH, Az.: IX R 3/09). Zuvor hatten sowohl das Finanzamt als auch das Finanzgericht die Steuerbegünstigung mit dem Argument, das Arbeitsverhältnis sei nicht beendet worden, abgelehnt. Dem widersprach der BFH. Eine Entschädigung werde als Ersatz für entgangene oder entgehende Einnahmen gewährt. Nach dem Gesetz müsse die Beschäftigung jedoch nicht gänzlich enden. Es setze nur voraus, dass Einnahmen wegfallen und dies entschädigt wird. Das sei der Fall, wenn eine Vollzeit- in eine Teilzeitbeschäftigung umgewandelt wird.
Endgültig entschieden ist der Streitfall allerdings noch nicht. Die Vorinstanz muss jetzt prüfen, ob die Beschäftigte bei der Änderung ihres Arbeitsvertrags unter Druck gehandelt hat.
